Terms of Use

1. Eligibility

You must be at least 18 years old to use the App. By using the App you confirm that you are 18 or older and able to enter into these Terms.

2. Not medical advice

NEXA is a personal journal and information tool. It is not a medical device and does not provide medical advice, diagnosis or treatment. Nothing in the App, including library content, catalog entries, the NEXA Assistant, the dose calculator, reminders, reports or any other feature, is a substitute for advice from a qualified healthcare professional.

Always follow the instructions of your doctor, pharmacist or other qualified clinician and the official product labeling. Never start, stop or change any medication, peptide, dose or schedule based on information in the App. If you think you may have a medical emergency, call your local emergency number immediately.

3. Your responsibility

You are solely responsible for:

• the information you enter and its accuracy;
• your decisions about what you take, how much, how and when;
• checking every dose, measurement and calculation with your clinician or pharmacist before acting on it;
• complying with the laws that apply to you, including laws on obtaining, possessing and using any medication, peptide or other substance.

4. Library, catalog and research content

The library and catalog are provided for general information only. Some entries describe substances that are not approved medicines in some or all countries, or that are sold as "research only" or "not for human use". Their inclusion is not an endorsement, recommendation or confirmation of safety, legality, quality or effectiveness. Content marked as unreviewed has not been independently reviewed and is for information purposes only. Information may be incomplete, out of date or inaccurate, and regulatory status differs between countries and changes over time.

5. Dose calculator

The dose calculator converts numbers you enter into a volume or syringe units. It does not suggest or verify any dose. Results depend entirely on the accuracy of your inputs and may contain errors. Always confirm any calculation with a pharmacist or clinician before use. You use the calculator entirely at your own risk.

6. NEXA assistant

The NEXA Assistant uses artificial intelligence to generate answers automatically. Answers may be inaccurate, incomplete or inappropriate for your situation, and are not medical advice. Do not rely on the Assistant for decisions about your health or treatment.

7. Reminders

Reminders depend on your device, its settings and notification permissions, and may be delayed or not delivered. Do not rely on the App as your only way to remember a dose.

8. Subscriptions and payment

Access to the App requires a paid subscription, purchased through Apple's App Store. Prices, billing periods and any free trial are shown in the App before you buy. Payment is charged to your Apple ID account at confirmation of purchase, or when a free trial ends. Subscriptions renew automatically at the same price for the same period unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription in your Apple ID account settings. Deleting the App or your NEXA account does not cancel your subscription. Refunds are handled by Apple under its policies; we cannot issue refunds directly. Any unused portion of a free trial is forfeited when you purchase a subscription.

9. Your account

You are responsible for keeping your account secure and for all activity under it. Tell us promptly at vessa.care@outlook.com if you believe your account has been used without your permission. You may delete your account at any time in the App.

10. Acceptable use

You agree not to misuse the App, including by:

• using it for any unlawful purpose;
• trying to access other users' data or our systems without authorization;
• interfering with or disrupting the App or its servers;
• copying, reverse engineering or reselling the App or its content except as permitted by law;
• using the App to promote or supply substances unlawfully.

We may suspend or terminate your access if you breach these Terms.

11. Your content

You keep ownership of the information and photos you add to the App. You give us a limited licence to store, process and display that content only as needed to provide the App to you, as described in our Privacy Policy.

12. Intellectual property

The App, its design, illustrations, text and software are owned by NEXA or its licensors and are protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on Apple devices you own or control, for your own personal, non-commercial use, subject to these Terms and the Apple Licensed Application End User License Agreement.

13. Disclaimer of warranties

To the maximum extent permitted by law, the App and all content and features are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of accuracy, reliability, fitness for a particular purpose, non-infringement, or that the App will be uninterrupted, error-free or secure. We do not warrant that any information in the App is accurate, complete, current or suitable for your circumstances.

14. Limitation of liability

To the maximum extent permitted by law, NEXA and its owners, employees, contractors and partners will not be liable for any direct, indirect, incidental, special, consequential, exemplary or punitive damages, or any loss of health, injury, loss of data, profits or goodwill, arising out of or related to your use of or inability to use the App, any content or calculation in it, any decision you make based on it, or any missed, delayed or incorrect reminder, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total liability for any claim relating to the App is limited to the amount you paid for the App in the 12 months before the claim arose.

Some jurisdictions do not allow certain warranties or liabilities to be excluded or limited. In those jurisdictions our liability is limited to the smallest extent permitted by law, and nothing in these Terms affects rights you have as a consumer that cannot be waived.

15. Indemnity

You agree to indemnify and hold harmless NEXA and its owners, employees and partners from any claims, losses, damages and expenses (including reasonable legal fees) arising from your use of the App, your content, your breach of these Terms, or your violation of any law or the rights of others.

16. Changes and availability

We may change, suspend or discontinue any part of the App at any time. We may update these Terms from time to time. We will post the updated version with a new effective date and, where the changes are significant, let you know in the App. Continuing to use the App after an update means you accept the updated Terms.

17. Governing law

These Terms are governed by the laws of UAE, without regard to its conflict of law rules. Any disputes will be resolved in the courts of UAE, unless the law of your country of residence requires otherwise.

18. Apple

These Terms are between you and NEXA, not Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support for it, and is not responsible for any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

19. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any right is not a waiver of it. These Terms and our Privacy Policy are the entire agreement between you and us about the App.
